Your legal responsibilities!

Payroll Support

If you decide to hire a nanny you must remember that you will be the nanny's employer and instantly have a set of responsibilities to your employee.

-    Register as an employer with the Inland Revenue
-    Set up and operate a PAYE (Pay As You Earn) scheme on your nanny's behalf
-    Keep tax records on her behalf
-    Provide your nanny with regular payslips
-    Provide a contract of employment between you and your nanny
-    Pay regular income tax and National Insurance Contributions
-    Pay employer's National Insurance Contributions
-    File an employer's annual tax return

We make it clear that the nannies we provide for our clients, on any basis, temporary or permanent cannot be self employed.

Contract of Employment

You are required by law to issue your nanny with what are called written Particulars of Employment within the first eight weeks of commencement of employment.  The written Particulars of Employment are:

-    Names of employer and employee
-    The date when employment began
-    Remuneration and intervals when paid
-    Hours of work (if flexible – maximum hours to be worked in any one week)
-    Overtime requirement and method of payment (additional pay/time off in
    lieu)
-    Holiday entitlement
-    Sickness entitlement
-    Pension arrangements, if any
-    Length of notice on both sides to terminate the contract
-    Title of the job
-    Place of work
-    Details of discipline and grievance procedures .

Nanny Duties

Nanny duties (nursery duties) normally involve the performance of all work concerning the child/s needs.  This includes:

 -    To advise and guide on child development, age appropriate activities,
      behavioural issues, and health & safety
 -    Washing, ironing, sewing of children’s clothes
 -    Changing nappies, bathing, and feeding of younger children
 -    Cleaning children’s bedrooms, bathroom & playroom and keeping tidy
 -    Washing & ironing of children’s bed linen
 -    Cleaning maintenance of all toys and play equipment
 -    Planning the days to be stimulating, educational and include fun activities
      and outings
 -    Attending playgroups, play-dates, park trips and children classes.
 -    Reading stories to younger children and encouraging older children to
      read, including help with their homework.
 -    School runs
 -    Babysitting by agreement

Nanny duties do not normally include cooking for parents or household cleaning, however some nannies may be happy to shop for the family, dog walk or perform similar agreed duties by prior arrangement.
